A justi\u00e7a do trabalho tem decidido que n\u00e3o h\u00e1 vinculo de emprego entre os motoboys entregadores vinculados a aplicativos, nem com a empresa que controla o aplicativo nem com empresa para a qual a entrega \u00e9 realizada, considerando esse profissional como aut\u00f4nomo. Ocorre que o mesmo entendimento n\u00e3o se aplica ao motoboy que presta seus servi\u00e7os diretamente para a\u00a0empresa para a qual a entrega \u00e9 realizada, ou seja, sem a intermedia\u00e7\u00e3o de aplicativos.<\/p>\n Em nosso escrit\u00f3rio temos casos em que a Justi\u00e7a do Trabalho reconhece o v\u00ednculo de emprego do motoboy com a empresa para a qual a entrega \u00e9 realizada, desde que preenchido os requisitos legais que configuram vinculo de emprego, quais sejam:<\/p>\n 🔹<\/span><\/span>pessoalidade, habitualidade, onerosidade e subordina\u00e7\u00e3o.<\/p>\n Vale lembrar que os requisitos legais s\u00e3o cumulativos, ou seja, no caso concreto todos os requisitos devem ser preenchidos. Em um dos casos que atuamos pelo motoboy a empresa alegou que o motoboy n\u00e3o trabalhava com habitualidade, haja vista que a sua jornada era as sextas-feiras, s\u00e1bados e domingos o que segundo a decis\u00e3o judicial n\u00e3o descaracteriza o v\u00ednculo pois a habitualidade n\u00e3o se mede por quantas vezes por semana o servi\u00e7os \u00e9 prestado mas sim pela continuidade da presta\u00e7\u00e3o de servi\u00e7os, que no caso citado perdurou por mais de um ano e atendia necessidade permanente da empresa e n\u00e3o eventual.<\/p>\n Outro ponto de destaque na decis\u00e3o foi a quest\u00e3o da profiss\u00e3o de motoboy ter mais de 1 (um) contrato de trabalho, o Juiz concluiu que em que tal fato n\u00e3o impede o reconhecimento do v\u00ednculo de emprego, pois no caso em espec\u00edfico um trabalho era realizado em hor\u00e1rio diurno e o outro em hor\u00e1rio noturno. Portanto, para reconhecimento do v\u00ednculo de emprego do motoboy e garantia de direitos como, f\u00e9rias + 1\/3, 13o, adicional de periculosidade, DRS\u2019s, FGTS, recolhimento INSS, aviso pr\u00e9vio, etc, \u00e9 necess\u00e1rio o preenchimento de todos os requisitos legais que configuram o v\u00ednculo de emprego.<\/p>\n ❗️<\/span><\/span>Motoboy, fique atento aos seus direitos!
